TERMS AND CONDITIONS OF CONTRACT FOR DETECT SERVICES ARE FORMALLY STATED AS BELOW

1. Detect Services Limited [the company ] undertake to use the best possible practices and equipment to perform the work specified in this contract but do not guarantee that all underground services will be located and that, if located, that the services are in the exact position marked.

2. While every care is taken to ensure that all services are reliably and accurately detected and located. Radio frequency and geophysical techniques, however, do not determine the type of service detected and can also be affected by variable local soil conditions and unknown interferences. Ground testing or potholing is recommended when absolute accuracy is required for safety purposes.

3. Detect Services Limited will take all practicable steps to ensure compliance with the Health And Safety in Employment Act 1992.

4. Terms of Payment:
a) The customer shall pay a deposit of 10% on request to the company upon signing this contract
b) The balance due on the contract shall be payable within 14 days of receiving the invoice statement from the company for the work.
c) Penalty interest at the rate of 2% per month {24% per annum} is payable by the customer to the company on any sum not paid on the due date for payment until full payment is made whether before or after any judgment is entered.

5. Consumer Guarantees Act:
a) Where the provisions or the Consumer Guarantees Act 1993 apply. The provisions of these conditions will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply.
b) Where the customer is a business [as “business” is defined by the consumer Guarantees Act [1993] it is agreed that it is acquiring the company’s services for the purpose of a business and that Consumer Guarantees Act 1993 does not apply.
